Is there a fine for driving and texting in Missouri?

On Behalf of | Jan 6, 2025 | Traffic Offenses

Imagine cruising down the scenic roads of Missouri, your favorite tunes playing softly in the background. Suddenly, your phone buzzes with a message. It can be tempting to check the text, but before you reach for your phone, there’s a new law you need to know about.

The state’s new approach to combating distracted driving could impact you more than you think. Here’s what you need to know.

Missouri’s driving and texting laws

Distracted driving has been linked to numerous accidents and fatalities in the state. In 2023, more than 100 people died due to this dangerous behavior.

To address this issue, state lawmakers introduced new legislation prohibiting drivers from holding their phones while operating a vehicle. More importantly, the grace period allowing residents to adapt to this new rule will end on January 1, 2025.

The end of the adjustment period means courts can impose a fine for distracted drivers. First-time offenders face a $150 fine, but those caught with their phones behind the wheel in active school or work zones must pay $500. Repeat offenders also have to pay the same amount.

It’s crucial to remember that distracted driving is a secondary offense. Law enforcement officials can only issue a citation if they initially stop you for a separate violation, such as exceeding the speed limit.

How a lawyer can help

If you are facing charges related to distracted driving, know that you don’t have to go through the legal process alone. Consulting with an experienced attorney can provide valuable insights into your case, help you understand your rights and guide you through the complexities of the legal system.
